The border guards in Odessa region has purchased engine oil for marine engineering more than 2 times more expensive compared to the closest competitor, despite violations of tender procedures and the decision of the Antimonopoly Committee.

27 December 2018 was held the auction on purchase of 50 tons of engine oils TPL 106 for marine engines. The organizer of the auction was made by a military unit of the State border service in Podolsk, Odessa region. Region which is under special attention of Russian aggression, continuing for the fifth year…

According to the system Prozorro (https://prozorro.gov.ua/tender/UA-2018-12-13-000470-b), in the bidding forms “the Negotiation procedure for defense purposes” № UA-2018-12-13-000470-b participated 4 companies, 3 of which offered a price of 50 tons of production just over 2 million UAH. and one, specifically the “ELS GROUP” (Kyiv) – 5,2 million UAH.!

For formal reasons, the head of tender Committee, namely, major Alexander Borovik, disqualifiziert 3 companies bid around 2 million UAH. and announces the winner of the “ELS GROUP”. All three companies participated in the tender complaint, which noted multiple errors in the tender documents from the “ELS GROUP” not meeting the qualification criteria and requirements. The Antimonopoly Committee decision №550-R/PK-PZ from 17.01.2019 requires a military unit to cancel the decision on the winning bidder. In accordance with the procedure in case of absence of the winner, the results of the auction had to be cancelled.

But instead, in contradiction with the tender legislation of Ukraine, the company “ELS GROUP” is invited to re-negotiate with the corrected documentation. What complaints one of the bidders, namely OOO “Torum” (Kiev), since according to the Law of Ukraine “On peculiarities of procurement of goods, works and services to ensure the needs of defence”, of paragraph 5 of article 6 renegotiation with the corrected documentation is not held.

In addition, another participant of auction the company “NPP Agrinol” (Berdyansk) in the following complaint to the Antimonopoly Committee’s claims about the fabrication of documents by the company “ELS GROUP” for eligibility requirements, namely, the alleged experience of trading oil “AGRINOL TPL 106”. The complaint States that “NPP Agrinol” has never been implemented and has not shipped the motor oil for marine engines “AGRINOL TPL 106” or the company “ELS GROUP”, or any other company for subsequent sale.

And this despite the fact that according to the Unified register of pre-judicial investigations, against the company “ELS GROUP” the criminal proceedings No. 12018060280000083 from 13.02.2018 on the grounds of a criminal offense under P1. St.358 of UK of Ukraine (“Forgery, seals, stamps and forms, their sale, use of counterfeit documents”).

But judging by the results of other trades Odessa border guards don’t care what their counterparty criminal proceedings and 2018 military unit 9935 of products purchased exclusively from this company almost 100 million budgetary hryvnias, according to the Prozorro declaring it the winner in 23 trades.

Moreover, the management tender Committee which consists of employees of this part, is a discriminatory position in relation to competitors, which is evident from numerous complaints. An example of such a complaint may serve as an appeal to the Antimonopoly Committee of July 11, 2018 of the company “IEE “Spectrasonics”, which fulfilled all the requirements of the tender, but which has not took a sample of diesel fuel is due to the fact that the “sample was not drawn correctly”.

According to available information, followed by a tender of 50 tons, the same military unit will tender for 150 tons that prices “ELS GROUP”, instead of 6 million will be more than 15,5 million UAH.

Without a doubt, on the face of an obvious crime and will respond, most likely, not only Prosecutors, but also of the SBU. All information in the public domain, all documents, claims and figures posted on the website Prozorro, the Odessa frontier guards “sawing” the defense budget, absolutely not hiding, while the President of Ukraine Petro Poroshenko, announced that only the day on February 15 in the Donbass died 1 Ukrainian soldier, and another 3 were seriously injured. Only with the beginning of the aggression, “Ukraine has lost only military – 2945 person.”
