In Odessa region the sailors of nine ships can’t vote – SUPPORT
KIEV. March 29. UNN. The Odessa district administrative court 28 March refused the claim on the obligations of OIC electoral district No. 143 make a decision on the establishment of special polling stations on a temporary basis on the vessels of PJSC “Ukrainian Danube shipping company”. This was reported by representatives of the Civil network OPORA, reports UNN.
As reported in the SUPPORT, the citizen – employee of the shipping company filed a claim for invalidation of the Protocol decision of the OIC of the electoral district No. 143 as of March 21, which the Commission upheld the consideration of nomination of members of precinct election commissions to the courts, “Ukrainian Danube shipping company”, which will be at sea on the voting day. The idea for the formation of PECs on ships was introduced on 20 March the acting Director of PJSC “UDP” for the purpose of formation of special polling stations on ships that departed to sea.
According to the Chairman of OIK No. 143 Oleg Dimov, who is quoted by the press service, the Commission received a presentation on the formation of special polling stations in nine vessels, who sail under the national flag, to create special polling stations, but the documents were submitted after the deadline.

“In the course of the trial the plaintiff’s representative, who will also be sailing on the day of the vote, answering the judge’s question, why the view on education of the PEC on the ship was not filed 30 days before election day, reported that at that time was not known schedule of ships sailing.
The representative plaintiff also explained that on March 20, when it became known that on March 31 the court will be in swimming, the OIC had made a representation to the formation of special polling stations in exceptional circumstances”, – is spoken in the message.
According to the SUPPORT, the court said that during the 10 days prior to election day, these polling stations are established by the Central electoral Commission, however, appeal to the OIC on the transfer of representation in the CEC was not.
After clarifying the circumstances, the court decided to refuse satisfaction of the claim.

“According to part 3, article 24 of the law of Ukraine “On presidential elections” precinct election Commission of special polling station formed on a ship which on the voting day is at sea, may be formed by district election Commission at the place of registry of the vessel on the recommendation of the captain of the vessel, which may be sent by technical means of communication until March 7, inclusive. On an exceptional basis, a special polling station with simultaneous formation of the PEC may be formed by the Central election Commission upon submission of the district election Commission, in case of unexpected exit of the ship to sail until 20 March (according to part 10 of article 20 and paragraph 5 of article 24),” explained the coordinator of the observation of the Civil network OPORA during elections in Odessa region Anatoly Boyko.
We will remind that in Odessa region the OIC was replaced by a number of leaders and members of the Commission. In addition, the formation of some district election commissions in Odesa oblast has occurred in violation of the terms.
