The Russian state Duma ratified the Protocol on the rules of appeals to the ECHR
Uncategorized April 13, 2017KIEV. April 12. UNN. The state Duma of Russia on Wednesday, 12 April, ratified the Protocol, which clarified the possibility for recourse to the European court of human rights, reports UNN with reference to Deutsche Welle.
So, according to the Protocol, reduces the deadline for applications to the European court of human rights from six to four months. In addition now the ECHR will perform subsidiary (auxiliary) role in relation to national legal systems.
In the explanatory Memorandum to the Protocol States that the principle of subsidiarity is expressed in the requirement of the rule of exhaustion of domestic remedies. Thus, the filing of a complaint to the ECHR is subsidiary, additional means of protecting the rights and freedoms of the individual with their possible violation in the framework of national legal systems.
As reported UNN, the Majlis of the Crimean Tatar people March 29 filed the complaint with the European court of human rights (ECHR) on the actions of the Russian authorities, including a representative body of the Crimean Tatars in the list of extremist organizations, banning its activities.
