In Gosgeokadastre explained why the moratorium on land sales will act after 1 January

KIEV. 23 Dec. UNN. The main condition for lifting the moratorium on sale of agricultural land was the entry into force of the law on turnover of lands. Since the adoption of the law has not occurred, entered into force paragraphs 14 and 15 section X “Transitional provisions” of the Land code of Ukraine. It is reported by UNN with reference to the Gosgeokadastr.

According to this point prior to the entry into force of the law on turnover of lands of agricultural purpose, but not earlier than January 1, 2020, prohibits the introduction of rights to land share (share) in authorized capitals of economic societies, and also not allowed:

– purchase and sale of agricultural land of state and communal property, lands, transferred to communal ownership in accordance with paragraph 21 of this section or transferred to municipal property in accordance with article 141 of the Law of Ukraine “On procedure for allocation in kind (on locality) of land plots to owners of land shares (shares) “, in addition to withdrawal (redemption) for public needs;

– purchase and sale or otherwise alienation of land plots and changing the purpose (usage) of land plots owned by citizens and legal entities for conducting a commodity agricultural production, land plots allocated in kind (on location) to owners of land shares (shares) for subsidiary farming, and land shares (shares), excluding their transfer by inheritance, exchange (barter) in accordance with the second paragraph of article 371 of this Code the land plot to another plot with the same regulatory rating or the difference between the normative monetary evaluation of which is not more than 10 percent, and withdrawal (redemption) of land plots for public purposes, and except for changing the purpose (usage) of land with a view to their provision to investors – participants of agreements on production section to carry out activities on such deals.

Derzeitiger also notes that the adoption and entry into force of the law of Ukraine on the circulation of lands of agricultural purpose is a prerequisite for the implementation of the land market.

About this the Chairman of Derzeitiger Dennis Hood said: “the Annual renewal of the moratorium had no legal meaning and perform primarily a PR goal for certain political forces. The absence of populism demonstrated by Parliament this year will not affect the rules of the game in the land market. Therefore, any panic, the forecasts did not contribute any bases”.

As is known, the Verkhovna Rada prolonged the moratorium on land sales after January 1, 2020, but not adopted the law on the sale of land.
