The court upheld the complaint of a Cyprus company Empson Limited, which owns 99,57% stake in the refinery.

The Supreme court of Ukraine cancelled the resolution on closing the appellate proceedings in the case of the transfer of state immovable property, which belonged to PJSC “Odessa oil refinery” (NPZ). The corresponding decision was made on April 4, reports delo.ua.

As they say in court materials, the Supreme court upheld the complaint of a Cyprus company Empson Limited, which owns 99,57% stake in the refinery. This company is associated with the fugitive businessman Sergei Kurchenko.

13 November 2015, the court granted the Prosecutor’s request about the transfer of custody of physical evidence on one of criminal cases against Kurchenko. The plant was transferred to the custody and management of the state enterprise “Ukrtransnaftoprodukt”.

The lawyer Empson Limited filed an appeal. 22 August 2018, the court closed the proceedings and returned the complaint citing the completion of the investigation.

According to the judges of the APU, such a decision violates the penal code. In the end, the complaint Empson Limited will be appointed to new consideration in court of appeal.

Recall that in 2013 the Odessa oil refinery from LUKOIL bought the group VETEK Kurchenko, who is wanted by Ukrainian law enforcement officers. Later it was reported the transfer of “VETEK” enterprise in pledge of JSC “Bank VTB” (Russia). Normal operation of the enterprise and has not been restored, it is currently idle.

Both companies (99,5766% and 100% respectively) are owned by Empson Cyprus Ltd (Cyprus), through which the GC VETEK bought the Odessa refinery from LUKOIL.

19 Jun 2017 Suvorovsky district court of Odessa adopted the decision on the special confiscation of the entire property complex of the Odessa refinery and “Energy and gas Ukraine” group “VETEK” Sergey Kurchenko.

At the end of July 2017 this decision confirmed the court of appeal. In addition, 100 thousand tons of petroleum products, entered the territory of Ukraine without payment of customs payments organization headed Kurchenko, was confiscated by the court.

In may 2018, the District administrative court of Kiev has upheld the order of the Cabinet of Ministers of 13 September 2017 No. 632-p on the transfer of property complexes of PJSC “Odessa oil refinery” and OOO “Energy and gas Ukraine” in the management of the state property Fund.
